TERMS AND CONDITIONS OF SALE AND USE

DESERT CAT CLUB RETAIL PRIVATE LIMITED

These Terms of Use and Sale ("Terms") constitute a legally binding contract between you (the "Customer", "User", or "You") and Desert Cat Club Retail Private Limited ("Company") governing access to the Platform and the purchase of Products.
Acceptance of these Terms is executed by clicking "I Agree", "Allow", or accessing and using the Company's web-based or mobile applications ("Platform").
B2B Representation & Authority: If you are accepting these Terms on behalf of a business entity (proprietorship, partnership, company, or limited liability partnership), you represent and warrant that you have full legal authority to bind such entity, and these Terms will be legally binding upon the business.

Customers are solely responsible for maintaining the strict confidentiality of their Access Credentials (passwords/OTPs) and for all transactions and activities occurring under their account.
In the event of suspected credential compromise, the Customer must immediately reset their Access Credentials on the Platform or reach out to customer support.
To satisfy background verification, KYC due diligence, and contract performance, the Company may collect user details including name, contact details, address proofs, identity proofs, billing/bank details, voluntary Aadhaar information, or authorized access to DigiLocker records.
Customer information provided for performance under a contract will be destroyed within 60 days following contract termination or upon a formal deletion request, after which it becomes irretrievable.

Customers acknowledge that all product orders and transactions on the Platform are entered into at their own risk and based on their own prudent judgment.
Customers grant the Company a limited, non-exclusive, worldwide, non-transferable license to store, reproduce, process, and transmit Customer Content solely to facilitate product features and transactions.
The Company reserves the right to process, analyze, aggregate, and anonymize transaction data into non-identifiable Resultant Data for analytical, statistical, and platform optimization purposes.
Personal and transactional data may be hosted on third-party servers located within or outside India, subject to the laws of the respective hosting jurisdiction.

Any product cancellation or refund request initiated by a Customer shall be governed strictly in accordance with the relevant policies established by the Company.

The Company retains all rights, title, interest, and Intellectual Property Rights in and to the Platform, Company Content, domain names, trademarks, and logos.
Customers are granted a limited, non-exclusive, worldwide, non-transferable license to access the Platform solely to browse, purchase Products, and manage Customer Content.
Customers shall not reverse engineer, decompile, modify, disassemble, or create derivative works of the Platform or any portion thereof.

The Company reserves the right to suspend Platform access without notice under conditions including:
- Suspicion of unauthorized account access.
- Maintenance operations.
- Customer-requested suspension.
- Directives or notices from governmental, regulatory, or legal authorities indicating a violation of applicable laws or standards.

Access to the Platform and Products is provided without express or implied warranties that operations will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by applicable law, the Company disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Company accepts no responsibility or liability for third-party links, applications, or external contents displayed on the Platform.

The Customer agrees to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, agents, and attorneys from and against any claims, liabilities, losses, damages, penalties, fines, and legal fees arising out of the Customer's breach of these Terms or violation of any applicable law.

These Terms are governed by and construed in accordance with the laws of India.
The Courts at Bangalore shall hold exclusive jurisdiction over any disputes or controversies arising under these Terms.
The Company reserves the right to modify these Terms at its sole discretion without prior explicit individual consent. Notice published via platform banners or updated terms constitutes sufficient notice, and continued platform usage reflects complete acceptance of updated Terms.
